Gays Can Start Marrying Now, Ninth Circuit Lifts Stay on Same-Sex Marriage

The news just broke: The Ninth Circuit court of appeals this afternoon lifted its stay on same-sex marriage, enabling gay couples to begin marrying ASAP.

The appeals court's action comes just two days after the U.S. Supreme Court dismissed the Proposition 8 case, claiming it was not its jurisdiction to decide the state's future on gay marriage. The court kicked the case back to the Ninth Circuit, which had previously invalidated Prop. 8, the state's voter-approved ban on gay marriage. In addition, the Supreme Court struck down the Defense of Marriage Act, where a 5-4 ruling deemed the 1996 law that prohibited same-sex couples from tax breaks and other benefits associated with marriage unconstitutional on equal protection grounds.

Initially, the ninth Circuit was expected to wait at least 25 days before lifting the injunction, giving the Supreme Court time to release a formal order. However, today's order allows couples to immediately tie the knot, just in time to kick off gay pride weekend.
